Driving under the influence is a serious offense in Illinois. It is illegal to operate a motor vehicle with a blood alcohol content (BAC) at or above 0.08%. Illinois law also prohibits driving with 5 nanograms per milliliter of THC in your blood or 10 nanograms per milliliter in another bodily substance.

A DUI conviction — or even a DUI arrest with a statutory summary suspension — can result in the loss of your driving privileges. The consequences go beyond fines and possible jail time: your license can be suspended or revoked, affecting every aspect of your daily life.

How DUI Risk Classification Affects Your Reinstatement

Before your hearing, an alcohol and drug evaluation will be performed by a licensed counselor. The result of that evaluation determines your risk classification, which in turn determines what treatment requirements you must complete and what type of hearing you will need:

  • Minimal Risk: Typically first-time DUI with BAC below 0.15%. Requires 10 hours of DUI risk education. May be eligible for an informal hearing.
  • Moderate Risk: First-time DUI with BAC between 0.15% and 0.19%, or refusal to test. Requires 10 hours of DUI risk education and 12 hours of early intervention. A formal hearing is typically required.
  • Significant Risk: Second DUI offense or first offense with BAC of 0.20% or higher. Requires 10 hours of risk education and 20 hours of substance abuse treatment, plus a continuing care plan.
  • High Risk: Three or more DUI-related offenses in the past 10 years, or an evaluation showing alcohol or drug dependence. Requires at least 75 hours of substance abuse treatment and active participation in a continuing care plan.
