Underage DUI and Driver’s License Reinstatement in Illinois
Protecting the Driving Privileges of Young Drivers in McHenry County and Northern Illinois
Illinois has a zero-tolerance policy for underage drinking and driving. Drivers under the age of 21 can face a statutory summary suspension for having any detectable amount of alcohol or drugs in their system — even below the standard legal limit. The consequences can be severe and long-lasting, affecting a young person’s ability to get to school, work, and other essential activities.
What Underage Drivers and Their Families Need to Know
For drivers under 21, any BAC above 0.00% can result in a license suspension under Illinois’s zero-tolerance law. Additionally, a DUI charge under the standard 0.08% BAC threshold still applies to underage drivers just as it does to adults.
A first offense for an underage driver can result in a suspension of three months to two years, depending on the circumstances. A second offense can lead to a revocation.
Getting an Underage Driver’s License Reinstated
The reinstatement process for an underage driver follows many of the same steps as an adult DUI case, including alcohol evaluations, required treatment or education, and a Secretary of State hearing. However, there are important distinctions in how the Secretary of State evaluates underage cases, and having an attorney who understands those nuances can make a significant difference.
